Scope
These terms govern the use of the HolaResidency website and client area, owned by Eduard Pinedo. Each service is governed in addition by the engagement letter you sign for it, which prevails in case of conflict.
No legal advice until you sign an engagement letter
The information on this website and the replies to contact or eligibility enquiries are general guidance. A lawyer–client relationship, and advice on your particular case, only begins once you have signed an engagement letter for that matter. We never file anything on your behalf without it.
Who handles your matter
Every matter is handled by the founding lawyer, Eduard Pinedo, who acts on your behalf under the signed engagement letter. Any contentious step (appeals and, where applicable, court proceedings) is handled in-house by the same lawyer, only with your express approval and, for court proceedings, under a specific engagement letter and fee agreement.
Fees
Our professional fees are fixed and quoted to you in writing before you sign the engagement letter. Official fees and charges (government fees, translations, certificates, apostilles and similar) are not included: they are paid separately, and their amount is set by the relevant authority and checked on the date of each application.
Obligation of means, not of result
Our obligation is to prepare and follow up your application diligently. The decision belongs to the consulate, the immigration office, the police, the tax agency or the competent authority, and no result is guaranteed. Fees are not refundable on the grounds that an authority refused or delayed an application.
Your obligations
- Provide truthful, complete and up-to-date information and documents.
- Tell us promptly about any change relevant to your matter (address, employment, income, travel, family situation).
- Keep your client area credentials confidential.
Right of withdrawal
Consumers have 14 days to withdraw from a contract concluded at a distance. If you expressly ask us to begin work within that period, you will pay for the part already performed, and you lose the right of withdrawal once the service has been fully performed.
Use of the website and client area
You agree to use the website and client area lawfully and not to upload content that is unlawful or belongs to third parties without authorisation. We may suspend access in case of misuse.
Liability
Our liability is limited to the fees paid for the affected service, except in cases of wilful misconduct or gross negligence.
Law and jurisdiction
Spanish law applies. Consumers may bring claims before the courts of their place of residence.
